LEGAL NOTICE GATES ZONING BOARD OF APPEALS JULY 14th, 2025 -NOTICE IS HEREBY GIVEN THAT THERE WILL BE A PUBLIC HEARING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF GATES, 1605 BUFFALO ROAD ON MONDAY, JULY 14th, 2025 AT 7:30 PM (Pre-agenda meeting 7:00PM) PERTAINING TO THE FOLLOWING: TABLLED ITEMS(S): 1. The application of Walmart Stores, Inc. seeking an area variance from Article IV § 190- 14(A) and Article XXV § 190-44(C) to reduce the number of parking spaces from 938 to 898 and to increase the building coverage to 25.6% when only 15% is allowed at 2150 Chili Avenue. NEW ITEMS(S): 1. The application of Eastern Bluebird Storage, LLC seeking an area variance from Article XXVII, § 190-161(A)(2) to construct a two-story climate controlled self-storage facility with a proposed side setback of 15.27 feet when 40 feet are required. The applicant is also seeking an area variance from Article IV, § 190-14(A) to allow 12 parking spaces when 79 spaces are required at 20 Industrial Park Circle. 2. The application of Scott Stockdale seeking an area variance from Article XIX § 190-94(C)(2) for the placement of a 10' x 20' shed which will encroach into the 8 foot side setback by approximately 1.6 feet at 1800 Chili Avenue. 3. The application of Louis Witt seeking an area variance from Article VI § 190-32(D)(1) to install a 6 foot wooden privacy fence in the front yard facing Marc Mar Trail at 4 Marc Mar Circle. 4. The application of Marissa & Kathryn Carmine seeking an area variance from Article VIII § 190-36(B) to install a 6 ft wooden privacy fence that will encroach into the 35 foot setback on Morncrest Drive by approximately 3 feet at 256 Hinchey Road.
