COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS -December 3, 2025 City of Rochester, 30 Church Street, Rm 005A, Rochester, NY 14614 585-428-6709 This Notice shall satisfy the above-cited two separate but related procedural notification requirements for activities to be undertaken by the City of Rochester. REQUEST FOR RELEASE OF FUNDS On or about December 19, 2025 the City of Rochester will submit a request to the U. S. Department of Housing and Urban Development (HUD) for the release of HOME funds under Title II of the Cranston-Gonzalez National Affordable Housing Act (NAHA) of 1990, in accordance with section 288 (42 U.S.C. 12838), to undertake a project known as Rochester Roots, for purposes of constructing 15 new units of affordable housing for ownership at 358 Jay Street, Rochester, NY 14608 and 13 other scattered sites in the JOSANA neighborhood in the Northwest quadrant of Rochester. The structures range in size from one to two units. Rochester's Cornerstone Group, in partnership with the Rochester Land Bank, will develop the properties. All units will be affordable to households with incomes at or below 80% of the Area Median Income. The projected total development cost is $10,076,834, with the City of Rochester proposing to provide $2,250,000 in HOME funds. FINDING OF NO SIGNIFICANT IMPACT The City of Rochester has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at: City Hall, 30 Church Street, Room 005-A, Rochester, NY 14614, and may be examined or copied weekdays 9 A.M. to 4 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Erik Frisch, Deputy Commissioner of Neighborhood and Business Development, of the City of Rochester, 30 Church Street, Room 005A, Rochester, NY, 14614 or by Email to erik.frisch@cityofrochester.gov. All comments received by December 18, 2025 will be considered by the City of Rochester prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Rochester certifies to HUD that Malik D. Evans, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Rochester to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Rochester's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Rochester; (b) the City of Rochester has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Jill M. Casey using CPDRROFBUF@hud.gov or directly to the HUD Buffalo Field Office Address (300 Pearl Street, Suite 301, Buffalo, New York 14202).
