LEGAL NOTICE ADOPTION OF LOCAL LAW SUBJECT TO PERMISSIVE REFERENDUM TOWN/VILLAGE OF EAST ROCHESTER -Notice is hereby given that the Village Board of Trustees of the Town/Village of East Rochester (the "Village"), Monroe County, New York, at a regular meeting thereof, held on the 11h day of June, 2026, duly adopted, subject to a permissive referendum, a Local Law, an abstract of which is as follows: ADOPTION OF LOCAL LAW PROVIDING FOR EVEN-YEAR ELECTIONS SUBJECT TO PERMISSIVE REFERENDUM SECTION 1. TITLE This Local Law shall be known and cited as the "Even-Year Elections Law of the Town/Village of East Rochester." SECTION 2. AUTHORITY This Local Law is adopted pursuant to the authority granted by Article IX of the New York State Constitution; Municipal Home Rule Law §10(1)(ii)(a)(1), authorizing local laws relating to the election of officers; and Village Law §3-302, authorizing the extension or reduction of terms of office and biennial elections. As a coterminous town-village operating under Village Law Article 17, the Governing Body of the Town/Village of East Rochester hereby exercises its home rule authority to voluntarily align local elections with even-numbered years. SECTION 3. FINDINGS AND PURPOSE The Governing Body of the Town/Village of East Rochester finds and declares that: (a) The New York State Legislature enacted the Even Year Election Law (Chapter 763 of the Laws of 2023), reflecting a statewide determination that consolidating local elections with state and federal contests in even-numbered years increases voter participation, improves democratic representation, and reduces the cost and confusion of separate election cycles. (b) The New York State Court of Appeals unanimously upheld the Even Year Election Law as constitutional on October 16, 2025. (c) The Town/Village of East Rochester, as a coterminous town-village, is currently exempt from the mandatory provisions of the Even Year Election Law pursuant to Town Law §80. Notwithstanding that exemption, the Governing Body finds it to be in the best interests of East Rochester residents to voluntarily align local elections with even-numbered years, consistent with the Legislature's stated intent to maximize voter participation across all levels of government. (d) Greater voter participation in local elections strengthens democratic governance and ensures that elected officials more fully represent the will of the community they serve. SECTION 4. ELECTIONS IN EVEN-NUMBERED YEARS Commencing with the general election held in November 2028, and continuing at every subsequent biennial interval thereafter, all elections for the offices of Mayor and Trustee of the Town/Village of East Rochester shall be held on the Tuesday next succeeding the first Monday in November of even-numbered years, in accordance with the general election schedule established under the Election Law of the State of New York. The full even-year election cycle for all offices shall be in effect commencing with the November 2030 general election. SECTION 5. TRANSITION PROVISIONS (a) Mayor and Trustees -- 2027 Election Cycle. The offices of Mayor and the two (2) Trustee seats whose terms are scheduled to expire in 2027 shall be placed on the ballot at the general election held in November 2027. Persons elected to such offices at the November 2027 general election shall serve a term of one (1) year, expiring upon the qualification of their successors duly elected at the November 2028 general election. Commencing with the November 2028 general election, such offices shall be filled for four-year terms at each successive even-numbered year general election thereafter. (b) Trustees -- 2029 Election Cycle. The two (2) Trustee seats whose terms are scheduled to expire in 2029 shall be placed on the ballot at the general election held in November 2029. Persons elected to such offices at the November 2029 general election shall serve a term of one (1) year, expiring upon the qualification of their successors duly elected at the November 2030 general election. Commencing with the November 2030 general election, such offices shall be filled for four-year terms at each successive even-numbered year general election thereafter. (c) No Shortening of Incumbent Terms. Nothing in this Local Law shall be construed to shorten the term of any officer currently serving in office. The transition provisions set forth in subdivisions (a) and (b) of this Section apply prospectively to offices as they are filled at future elections and do not affect the term of any officer in office at the time of adoption of this Local Law. (d) Preservation of Staggered Terms. The staggered structure of the Board of Trustees is hereby preserved. Following completion of the transitions set forth in subdivisions (a) and (b) of this Section, the Mayor and two (2) Trustee seats shall appear on the ballot in 2028 and every four years thereafter, and two (2) Trustee seats shall appear on the ballot in 2030 and every four years thereafter. SECTION 6. EFFECT ON EXISTING LAW All provisions of any prior local law, ordinance, resolution, or order of the Town/Village of East Rochester inconsistent with this Local Law are hereby superseded to the extent of such inconsistency. SECTION 7. SEVERABILITY If any provision of this Local Law or the application thereof to any person or circumstance shall be held invalid, the remainder of this Local Law and the application of such provision to other persons or circumstances shall not be affected thereby. SECTION 8. FILING AND EFFECTIVE DATE This Local Law is subject to a permissive referendum pursuant to § 24 of the Municipal Home Rule Law and Article 9 of the Village Law, including § 9-900 thereof, and shall take effect upon filing with the Secretary of State pursuant to § 27 of the Municipal Home Rule Law following compliance with all applicable referendum requirements.
