New York State Department of Environmental Conservation Notice of Complete Application -Date: 09/09/2026 Applicant: MORRELL BUILDERS, INC., 1501 PITTSFORD VICTOR ROAD, SUITE 100, VICTOR, NY 14564 Facility: WINTERGARDEN SECTION 2 NORTHERN LIGHTS DR/Addition to the existing Wintergarden Section 1 development located along Nightfrost Lane, HENRIETTA, NY 14467 Application ID: 8-2632-00442/00001 Permits(s) Applied for: 1 - Article 24 Freshwater Wetlands Project is located: in HENRIETTA in MONROE COUNTY Project Description: The applicant is proposing the development of an approximately 12.57 acre parcel for a residential subdivision containing 23 new single family homes. The project is located within proximity to Red Creek (Class C) and will involve the disturbance of approximately 0.01 acres of the regulated freshwater wetland adjacent area. The development in the adjacent area will be limited to grading and erosion control activities. Landscaping will be provided to give a green space buffer and minimize impacts to the stream and wetland. Availability of Application Documents: Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed. SEQR Lead Agency Henrietta Town Planning Board State Historic Preservation Act (SHPA) Determination The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.
