TO THE ABOVE-NAMED DEFENDANTS:
YOU ARE HEREBY SUMMONED to answer the Complaint in the above action and to serve a copy of your Answer on the Plaintiff's attorney within twenty (20) days after the service of this Summons, exclusive of the day of service, or within (30) days after completion of service where service is made in any other manner than by personal delivery within the State. The United States of America, if designated as a Defendant in this action, may answer or appear within sixty (60) days of service hereof. In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the Complaint.
Monroe County is designated as the place of trial. The basis of venue is the location of the mortgaged premises.

Sending a payment to your mortgage company will not stop this foreclosure action.

NATURE AND OBJECT OF ACTION: The object of the above action is to foreclose a mortgage held by Plaintiff bearing the date the 14th day of August 2017, executed by Thomas K. Bolton to ESL Federal Credit Union to secure the sum of $84,800.00, and recorded in the Monroe County Clerk's Office on the 18th day of August, 2017 in Book 27279 of Mortgages at page 32; and a further mortgage bearing date the 28th day of March 2019, executed by Thomas K. Bolton to ESL Federal Credit Union to secure the sum of $23,200.00 and recorded in the Monroe County Clerk's Office on the 3rd day of April 2019 in Book 27973 of Mortgages at page 0117; which mortgages were consolidated by Consolidation Extension and Modification Agreement recorded April 3, 2019 in the Monroe County Clerk's Office in Book 2 7973 of Mortgages, page 0126 forming a single lien in the amount of $108,000.00. TO THE ABOVE-NAMED DEFENDANTS, The plaintiff makes no personal claim against you in this action except for Thomas K. Bolton. The foregoing Summons is served upon you by publication pursuant to an Order of the Hon. James E. Walsh, Jr., a Justice of the Supreme Court of the State of New York, dated September 22, ,2026 and filed along with the supporting papers in the
Monroe County Clerk's Office. This is an action to foreclose a mortgage. The premises are described as follows:
All that tract or parcel of land, situate in the Town of Irondequoit, County of Monroe and State of New York, known and described as a certain lot as laid out on a map of a Resubdivision of Lots 808 to 813, inclusive, of Laurelton (Section B) filed in Monroe County Clerk's Office on the 2nd day of May, 1950, in Liber 107 of Maps, at Page 17; said lot being specifically known and designated on said map as follows: Lot Number R-811 on the north side of Hurstbourne Road.
