Pursuant to § 47A-16 B, the Commissioner of Neighborhood and Business Development hereby declares an emergency and orders the carriage house located at 1771 Saint Paul Street to be demolished. This declaration is based on an inspection of the property by a New York State Certified Code Official who found that it is in imminent danger to the public health, safety, and welfare.
The carriage house located at 1771 Saint Paul Street has suffered significant structural damage due to a tree that fell onto the property. The structural integrity of building has been compromised to a point where it has become unstable. The status of this property is a serious blight to the neighborhood and in violation of the City of Rochester Property Maintenance Code. Furthermore, the structure and site in its current condition are an attractive nuisance and could be life-threatening for those who choose to enter the structure. Finally, the structure poses an enhanced danger to any emergency responders who may have to enter the premises.
You are hereby advised, that if you fail to demolish the carriage house within three (3) business days, the City will cause the carriage house located at 1771 Saint Paul Street to be demolished. You are advised to remove any personal property from the structure prior to demolition. Failure to remove any personal property may result in damage or loss during demolition for which the City takes no responsibility. Please be advised that you must apply for and obtain a demolition permit before you start any demolition work.
You are hereby further advised, Pursuant to § 47A-16 F, the cost of the demolition shall be a personal liability of the owner, and the Commissioner shall bill the owner therefore. The cost of the demolition shall include the cost of removal of debris. Such cost shall also be a lien upon the property from the first day the cost is billed to the owner. Such cost shall be assessed and billed to the owner as set forth in § 6-92 of the City Charter, shall be subject to late payment charges as set forth in § 6-93 of the City Charter, and may be added to the subject property tax bill as set forth in § 6-94 of the City Charter.
You are hereby further advised that you have a right to a hearing to review the Commissioner's declaration of imminent danger. You may submit a written demand fora hearing to the City of Rochester, Demolition Unit, 30 Church Street - Room 028B, Rochester, NY 14614, or contact our office at (585) 428-6963 no later than 12:00 pm noon on the business day following the third consecutive day of publication of said declaration of imminent danger.
