LEGAL NOTICE OF RESOLUTION AND ORDER SUBJECT TO PERMISSIVE REFERENDUM TOWN BOARD OF THE TOWN OF PERINTON, NEW YORK JEFFERSON AVENUE SEWER DISTRICT PHASE 2 – EXTENSION NO. 74 TO PERINTON CONSOLIDATED SEWER DISTRICT NO. 8 -NOTICE IS HEREBY GIVEN that the Town Board of the Town of Perinton, Monroe County, New York, at a regular meeting held on September 21, 2026, duly adopted an Order and Resolution approving the extension of the Perinton Consolidated Sewer District (PCSD) No. 8, designated as the Jefferson Avenue Sewer District Phase 2 - Extension No. 74, pursuant to the provisions of Article 12-A of the Town Law of the State of New York, which Order and Resolution is subject to a permissive referendum pursuant to Section 209-e and Article 7 of the Town Law. A summary of the resolution and order is as follows: 1. Proposed Improvement and Territory: The project includes the construction and installation of approximately 3,800 linear feet of 8-inch diameter gravity sanitary sewer collection main, together with manholes, service laterals, appurtenances, approximately 4,600 linear feet of replacement storm sewers, and full roadway reconstruction along Pilgrim Circle, Woodcrest Circle, Briarwood Lane, and Garden Drive, providing public sewer availability to fifty-two (52) existing residential parcels currently served by individual on-site septic systems. The boundary description of the territory included within said Extension No. 74 is set forth in the Map, Plan, and Report prepared by MRB Group, on file in the Town Clerk's Office. 2. Maximum Amount to be Expended: The total maximum estimated cost of the project (including preliminary and final engineering design, survey, construction, legal, administrative, and inspection costs) is $7,712,700.00, which cost is proposed to be financed through the issuance of serial bonds of the Town of Perinton under the Local Finance Law, payable through assessments upon the benefited properties and the Perinton Consolidated Sewer District No. 8. 3. Estimated Cost to Typical Property Owner: o For a typical single-family property connecting to the sewer system, the estimated average annual cost for debt service and operation and maintenance is $293.55 (consisting of approximately $190.35 in PCSD capital and O&M charges, and approximately $103.20 in Monroe County Pure Waters capital and O&M charges). o For a typical single-family property owner electing not to connect to the sewer system, the estimated average annual debt service cost is $117.89 (consisting of approximately $91.89 in Town sewer debt and $26.00 in MCPW sewer debt charges). 4. Permissive Referendum Requirements: Said Order and Resolution was adopted subject to a permissive referendum pursuant to Section 209-e of the Town Law. The resolution and order shall not take effect until thirty (30) days after its adoption; nor shall it take effect if within thirty (30) days after its adoption (specifically on or before October 21, 2026), there be filed with the Town Clerk a petition subscribed and acknowledged by the owners of taxable real property situate in the proposed extension, owning in the aggregate at least five percent (5%) of the total assessed valuation of all the taxable real property of the proposed extension as shown upon the latest completed assessment roll of said Town, or subscribed and acknowledged by at least one hundred (100) or five percent (5%) of the registered voters residing within the proposed district extension, protesting against the adoption of such resolution and order and requesting that the matter be submitted to a referendum of the property owners or electors qualified to vote thereon.
